The Patna High Court Thursday stayed an order to arrest controversial Rashtriya Janata Dal Member of Parliament Mohammed Shahabuddin in one of the three warrants pending against him. But the state police chief said two other non-bailable warrants against the MP would be executed soon.
The order comes a day after Bihar Chief Secretary G S Kang and Director General of Police A R Sinha said Shahabuddin would be arrested on the directive of the Election Commission to execute non-bailable warrants of arrest pending against all persons in the state.
The order refers to a non-bailable warrant in connection with Bihar Control of Crime Act case issued by Siwan District Magistrate Santosh Mal.
The court allowed the district magistrate to conclude the proceedings initiated by him against Shahabuddin within a month and pass an appropriate order.
The Bihar police told the court that two other warrants were pending against Shahabuddin. One in connection with the recovery of illegal firearms and ammunition and a deer during a raid on his ancestral house at Pratappur, Siwan district in April and another a power theft case.
Kang on Wednesday said the state administration would execute the warrants in a week.
Earlier, the High Court had on July 13 stayed the execution of the warrant issued by Mal and directed him to explain the reason for issuing the order. Before issuing the warrant on June 22, Mal had issued summons to Shahabuddin for appearance on an earlier order by his predecessor C K Anil to book the MP under CCA for his alleged involvement in criminal activities post February 18, the day Anil had externed him from the district for six months.
Shahabuddin was released from Bihar's Beur jail in February.
