A five-judge constitution bench headed by Justice Y K Sabharwal will give its order on the dissolution of the Bihar assembly on Friday morning at 10.30 a.m. The court had reserved its ruling after hearing the petition filed by Rameshwar Prasad Chaurasia.
In his petition Chaurasia had challenged the dissolution of the Bihar assembly by Governor Buta Singh as being done merely on whims and facies.
Buta Singh, in his report, had claimed that since there was horse-trading going on in the state for the formation of the government, the Centre should impose president's rule and dissolve the Bihar assembly.
Bihar was placed under president's rule on May 23, 2005 and the state assembly was dissolved forceing another elections in the state in less than one year.
During the hearing the court had repeatedly commented that the papers produced in the court did not shed any light on the so-called horse-trading.
