HC refrains from issuing notice on Quattrocchi's accounts

Observing that the application was flawed, the Delhi High Court Friday refrained from issuing notices to the Centre on a petition seeking dismissal of the Solicitor General and two others for tendering "wrong advice" on de-freezing London bank accounts of Italian businessman Ottavio Quattrochhi, an accused in the Bofors pay-offs.

A Division Bench of Justice Vijender Jain and Justice Rekha Sharma, however, asked petitioner Rashtriya Mukti Morcha to amend its petition and file a fresh application before the court.

During the brief arguments, the court asked senior counsel P N Lekhi, appearing for the petitioner, as to under what remedy he was seeking the dismissal of the Solicitor General and the two Additional Solicitor Generals.

The Bench said it would be a mockery of law if the court starts entertaining applications that challenge the advice rendered by government officers while discharging their duties.

"It is an advice or an opinion by legal officers, so how can we decide on it," the Bench added.
