SC refuses to entertain Shahabuddin's petition

The Supreme Court has refused to entertain Rashtriya Janata Dal member of Parliament M P Shahabuddin's petition challenging the Patna high court's order to constitute special courts to try him in jail.

A bench of Justice G P Mathur and Justice Talveer Bhandari on Friday asked him to approach the Patna high court and challenge the high court's administrative decisions in judicial proceedings under Article 226 of the Constitution.

The bench pointed out that the petitioner has not submitted copies of the high court's notification dated May 20 and in the absence of that document, the petition could not be considered.

As the court made it clear that it would not entertain the petition, Shahabuddin's counsel chose to withdraw it.

However, on the request of Shahabuddin's counsel, the court asked the Patna high court registrar general to make available a copy of the notification to the accused.

The high court had ordered constitution of special courts under Bengal, Agra and Assam Civil Courts Act to try Shahabuddin's cases.

His counsel had contended that the Act was not applicable in this case.

Shahabuddin is accused in about 40 criminal cases.
