The Supreme Court on Friday stayed the death sentence of Mohammed Shoeb Kasam Ghansar, a death row convict in the 1993 Mumbai serial bomb blasts case.
A bench comprising Chief Justice K G Balakrishnan and Justices R V Raveendran and Markandey Katju also issued notices to the CBI and admitted the appeal of the petitioner, challenging his conviction and sentence in the case by TADA court, Mumbai.
The petitioner has challenged his conviction on the grounds that the trial judge had failed to appreciate the prosecution's failure to prove the case against him beyond reasonable doubt.
He also contended that he has been convicted without any evidence to show that he was involved in the criminal conspiracy, which led to the killings of about 200 people on March 12, 1993, when Mumbai was rocked by series of bomb blasts.
The apex court also admitted the appeal of the petitioner.
