The Narcotics Control Bureau has moved the high court against lower court's decision of framing charges for possession of 1 gm of cocaine against actor Fardeen Khan.
Fardeen was arrested by the NCB in 2001 while taking delivery of cocaine from Nasir Shaikh, a drug peddler.
While the NCB wants to frame charges against him for possession of 9 gms of cocaine -- seized from Nasir the special Narcotics Drugs and Psychotropic Substances court held that charges should be framed only for 1 gm, which Fardeen says he wanted to buy.
Under the NDPS Act, possession of 1 gm of cocaine attracts a six month jail term, or the option to undergo rehabilitation therapy. For 9 gm, the punishment is a term upto 10 years.
The NCB has challenged NDPS court's decision in the High Court.
Fardeen has not denied that he was trying to buy cocaine. The petition will come up for hearing on July 9, said additional government pleader Purnima Kantharia
